5. No Guarantee of Approval

Submission of a loan application does not constitute a commitment to lend or a guarantee of loan approval. Loan approval is subject to credit review, income verification, property appraisal, and lender underwriting guidelines. Mortgage Depot makes no warranties regarding the outcome of any loan application.

Factors Affecting Loan Approval: Loan approval decisions are made by the lending institution based on various factors, including but not limited to:

  • Credit history and credit score
  • Debt-to-income ratio
  • Employment history and income stability
  • Property value and condition (determined by appraisal)
  • Down payment amount and source of funds
  • Loan-to-value ratio
  • Compliance with lender-specific underwriting guidelines

Changes in your financial situation, employment status, or creditworthiness between application submission and loan closing may affect your eligibility. You are required to notify us immediately of any material changes to your financial circumstances.

6. Fees and Costs

All applicable fees, costs, and charges associated with your mortgage will be disclosed to you in accordance with the Real Estate Settlement Procedures Act (RESPA) and the Truth in Lending Act (TILA). You will receive a Loan Estimate detailing all costs prior to proceeding with your application.

Comparison Shopping: We encourage you to compare loan offers from multiple lenders. The Loan Estimate is designed to facilitate easy comparison of loan terms and costs.

Non-Refundable Fees: Certain fees, such as appraisal and credit report fees, may be non-refundable if you decide not to proceed with the loan after these services have been performed. This will be clearly disclosed to you.

  • SMS Consent Communication: The information (phone numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

14. Dispute Resolution and Arbitration

Class Action Waiver: You and Mortgage Depot agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. Neither party may bring a claim on behalf of other individuals or entities.

Exceptions: This arbitration agreement does not apply to disputes that are required by law to be resolved in a specific manner, such as claims brought before regulatory agencies or disputes involving mortgage foreclosure proceedings.

15. Regulatory Compliance

Mortgage Depot is licensed and regulated by state and federal authorities. Our lending activities comply with:

  • Real Estate Settlement Procedures Act (RESPA): We provide required disclosures about loan costs and settlement services.
  • Truth in Lending Act (TILA): We disclose the terms and costs of credit in a clear and standardized format.
  • Equal Credit Opportunity Act (ECOA): We do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age, or receipt of public assistance.
  • Fair Housing Act: We comply with federal fair housing laws and provide equal housing opportunities to all applicants.
  • Home Mortgage Disclosure Act (HMDA): We collect and report data on mortgage applications as required by law.

17. Entire Agreement

  • Pandemics, epidemics, or public health emergencies

In the event of a force majeure occurrence, we will make reasonable efforts to resume normal operations as soon as practicable and will communicate with you regarding any significant delays in processing your loan application.

19. Assignment

You may not assign or transfer these Terms and Conditions or your rights and obligations hereunder without our prior written consent. Mortgage Depot may assign these terms, in whole or in part, to any affiliate, successor, or third party in connection with a merger, acquisition, reorganization, or sale of assets without your consent. These terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

20. Acknowledgment and Acceptance

By submitting a loan application, using our website, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You represent and warrant that you have the legal authority to enter into this agreement and that all information you provide is accurate and complete.

If you do not agree to these Terms and Conditions, you must immediately cease using our website and services and refrain from submitting any loan applications or personal information to Mortgage Depot.
